Waiver, Release of Liability and Assumption of Risks

In consideration of your participation in Palm Tennis activities and use of any facilities/premises, you hereby release from, and covenant not to sue Palm Tennis owners,members, directors, officers, employees, representatives, agents, lessors and lessees for, any and all present and future claims resulting from negligence, inherent risk of sport or exercise or otherwise; including but not limited to any loss, injury, damage or liability sustained by you while on or about any Facilities/Premises, playing or not playing.

Palm Tennis is not responsible for any injury to, including death, or loss of property, of any person suffered while on any premises or participating in any Palm Tennis Leagues and activities including but not limited to playing or practicing tennis or spectating or any other activity.

You are fully aware and understand that Palm Tennis does not employ or contract with any medical service providers for ordinary or emergency medical services. You will be fully responsible for any use you make of medical supplies or equipment which may be found on any facilities and agree that the terms of this waiver and release shall apply to any person who in good faith uses such supplies or equipment to assist you if you are unable to do so.

You are also fully aware and understand that losses, injury, damage, liability, disability, or even death may result from actions, inactions or negligence on your part, on the part of Palm Tennis, or on the part of others, as well as from the rules of play of tennis and the condition of the facilities/premises.

You further agree that you are knowledgeable in the proper use of the Premises and equipment and with the risks inherent in playing tennis. You further agree to indemnify and hold harmless Palm Tennis, its owners,members, directors, officers, employees, representatives, agents, lessors and lessees for and from any and all claims arising from my involvement in activities of Palm Tennis at court facilities or any other Premises or otherwise or incidental thereto wherever, whenever, and however the claims may arise; including but not limited to travel to and from Facilities/Premises or related activity sites.

You do hereby for and on behalf of yourself, your heirs, executors, administrators, next of kin, successors, agents, assigns, personal and legal representatives, and anyone else who might claim on your behalf, indemnify, hold harmless, release and forever discharge Palm Tennis and its successors and assigns, of and from any and all claims, demands, costs and damages, losses or injuries, including, without limitation, the risks of contracting a communicable disease or illness (including, but not limited to, the disease designated as COVID-19 or the related virus designated SARS-CoV-2, or the exposure to any other bacteria, virus or other pathogen capable of causing disease or illness) which may be suffered or sustained by you.

You assume all the foregoing risks and accept personal responsibility for any damages and loss following any loss of property, injury, permanent disability, or death resulting from your use of Facilities, Premises or participation in any Palm Tennis activities. You have read and fully understand the above waiver, release, and assumption of risk and fully understand that you have given up substantial rights by this waiver
